Social Security is exempt only below an income line

Since tax year 2022, New Mexico exempts the Social Security included in federal adjusted gross income when AGI is no more than $100,000 single, $150,000 joint or $75,000 married filing separately. It works as a cliff, not a phase out: above the line, no part of the benefit qualifies.

An exemption of up to $8,000 each from age 65

Taxpayers 65 or older can exempt up to $8,000 each from taxable income. For tax year 2025 the full amount applies up to $30,000 of federal AGI on a joint return or $18,000 single, and it steps down to zero above $51,000 joint or $28,500 single.

Lower income owners 65 and over can freeze assessed value

A single family home owned and occupied by someone 65 or older whose prior year modified gross income is within the limit keeps its assessed value at the level of the year they qualify and apply. The limit is $44,200 for tax year 2026, based on 2025 income, and adjusts for inflation each year.

Two 2026 bills to widen the Social Security exemption, SB 156 and HB 92, died, so the income lines above still apply. The property freeze needs a claim filed with the county assessor, generally within 30 days of the valuation notice.
